Consent and Release

Beverly Glen Laboratories, Inc. (“BGL”) performs skin diagnosis using photographic images of your face. By checking the checkbox and taking selfie(s), you are acknowledging that you have read, fully understand and agree to this policy ("Policy of Use and Security regarding Selfies") regarding the collection, use and storage of selfie data (hereinafter simply referred to as “Policy”).

Article 1. Acknowledgement

You expressly agree that BGL, its third-party vendor(s) and service provider(s) (all the parties may be hereinafter collectively referred to as "Data Obtainer") obtain, collect, store and use selfie data of your face such as wrinkles, spots, color and tone.
You understand and agree that the purpose for which Data Obtainer obtains, collects, uses and stores your selfie data is to propose you personalized products and skin care methods.
You agree that BGL has the right to disclose your selfie data to its service provider(s) and/or third-party vendor(s) solely for the purpose stated in the preceding paragraph.
You agree that, unless otherwise prohibited by law, Data Obtainer has the right to store and use your selfie data for up to one year from the date such data is obtained, as long as the data is used solely for the purpose stated in Paragraph 2 hereof.
You assure BGL that, in the place where you reside, you are over 18 years old and a major, and that you have the authority to allow BGL to use your selfie(s) pursuant to this Policy.

Article 2. Security

1. Purpose and Outline

The Policy of Use and Security regarding Selfies provides guidelines for the collection, storage, use and disposal of your selfie data. The purpose of this policy is to define the administrative and technical handling methods of your selfie data in light of safety and security. BGL and its third-party vendor(s) and/or service provider(s) shall properly handle your selfie data based on this policy.

2. Collecting Selfie Data

Before collecting or requesting your selfie data, Data Obtainer shall:
1. notify you of the purpose of collection, storage or use of your selfie data and of the period during which such selfie data can be used and stored and,
2. obtain a written signature from you or obtain consent by using BGL’s online consent form, with regard to collection, storage and use of your selfie data.
Please note that the consent form accessed via mobile devices or online web browsers can be digitally signed by you in accordance with the Federal E-SIGN Act. When signing by giving digital signature consent to BGL, you will be presented with all terms and conditions and are to take proactive actions (for example, writing your name or clicking on unchecked checkboxes, etc.) to agree to the terms. BGL will not collect any data from you unless you take such proactive actions. If requesting a digital signature on the consent form, BGL shall provide you with an option where you can peruse and sign a paper-copy of the consent form.

3. Use of Selfie Data

BGL shall be allowed to collect, store and use solely for the purpose described above. In some cases, a service provider that has a contractual relationship with BGL may collect, store and use such data on behalf of BGL. In no way shall BGL and its service provider(s) give, sell or lease your selfie data to any third party. In addition, BGL and its service provider(s) shall not disclose or distribute such data to any third party excluding the cases where BGL is (i) approved by you, (ii) required by federal, state or local law, or (iii) received a warrant, subpoena or court order issued by a court of competent jurisdiction.

4. Protection of Selfie Data

BGL uses industry-standard information security safeguards to protect your selfie data. Those safeguards include firewalls, intrusion prevention systems, encryption, access restrictions, authentication and authorization systems, system logs, file backups, and network monitoring solutions.

5. Data Retention Period

BGL uses your selfie data to provide you with a proposal for personalized skin care methods. For the purpose described above, all of your selfie data are anonymized, aggregated and stored for a maximum of one year from the date of collection.

6. Destruction of Selfie Data

As soon as Data Retention Period expires, your selfie data will be completely destroyed so that they cannot be recovered.

7. Discipline

If an employee permitted by BGL to access your selfie data (hereinafter, "authorized employee(s)”) violates this policy, he/she may be subject to disciplinary action by BGL. If an authorized employee becomes aware of any breach of this policy, he/she shall immediately notify his/her direct superior/manager, legal manager and/or a contact of BGL's service provider(s).
